These Terms of Service ("Terms") govern your use of the SwiftMove USA website and services. By booking a move or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Acceptance of Terms

By accessing swiftmoveusa.com, requesting a quote, booking a move, or engaging SwiftMove USA, LLC ("Company") in any capacity, you ("Customer") confirm that you are at least 18 years of age and legally capable of entering into binding contracts, and that you accept these Terms in their entirety.

2. Our Services

SwiftMove USA provides interstate and intrastate moving, freight shipping, auto transport, storage, and related logistical services throughout the United States. Services are subject to availability and may vary by location. We reserve the right to decline any move or shipment at our sole discretion.

Specific service terms (pickup windows, delivery estimates, crew size) are confirmed in your written moving order or Bill of Lading, which supplements and is incorporated into these Terms.

3. Booking & Payment

Quotes: All quotes are based on information provided by the Customer. Final pricing may be adjusted if actual weight, volume, or conditions differ materially from the quote information. We will notify you of any material change before proceeding.

Binding vs. Non-Binding Estimates: Customers may request a binding estimate (fixed price) or a non-binding estimate (subject to final weight). The type is specified in your moving contract.

Deposit: A deposit is required to confirm your booking. The deposit amount will be specified in your quote. Deposits are applied toward your total balance.

Payment Due: The remaining balance is due upon delivery of your belongings, before unloading. We accept credit/debit cards, ACH transfer, and cash. We do not accept personal checks.

Late Payment: Balances not paid within 30 days of delivery are subject to a 1.5% monthly finance charge.

4. Cancellation & Rescheduling Policy

  • Cancellation 7+ days before move: Full deposit refund.
  • Cancellation 3โ€“6 days before move: 50% deposit refund.
  • Cancellation within 72 hours: No refund of deposit.
  • Rescheduling: Free rescheduling with 7+ days notice, subject to availability. Rescheduling with less than 72 hours notice may incur a fee up to $250.

SwiftMove USA reserves the right to cancel or postpone moves due to severe weather, natural disaster, or force majeure events. In such cases, we will reschedule at no additional charge or provide a full refund.

5. Liability & Insurance

Released Value Protection (Included): At no extra charge, all moves include the minimum federal protection of 60 cents per pound per article. This is not full-value coverage.

Full Value Protection (Recommended): For full replacement or repair coverage, customers may purchase Full Value Protection. Details and pricing are provided in your quote.

High-Value Items: Items valued over $100 per pound must be declared in writing on the High-Value Inventory Form prior to pickup. Undisclosed high-value items are covered at 60 cents per pound only.

Property Damage: SwiftMove USA is not responsible for damage to buildings, driveways, elevators, or other structures that is incidental to the normal moving process, unless caused by gross negligence of our crew.

6. Prohibited Items

The following items CANNOT be transported by SwiftMove USA:

  • Hazardous materials: explosives, flammable liquids, compressed gases, corrosives
  • Firearms, ammunition, or weapons (except unloaded, properly cased firearms in intrastate moves where permitted by law)
  • Controlled substances or illegal drugs
  • Perishable food items (on long-distance moves over 24 hours)
  • Living plants (on interstate moves)
  • Live animals or pets
  • Items of sentimental value irreplaceable by money (move these yourself)

Including prohibited items in your shipment without disclosure may result in forfeiture of your insurance coverage and may expose you to legal liability.

7. Claims Process

Damage and loss claims must be submitted through our official claims portal at claims.html within 9 months of your delivery date. Claims submitted after the deadline will not be accepted. The filing of a claim does not entitle the customer to withhold payment of the outstanding balance.

SwiftMove USA will acknowledge your claim within 5 business days and provide a written disposition within 30 days of receiving all required documentation.

8. Dispute Resolution

Informal Resolution: We encourage you to first contact our customer service team at +1 (856) 930-0783. Most disputes are resolved at this stage.

Arbitration: Any dispute not resolved informally shall be settled by binding arbitration under the American Arbitration Association (AAA) Commercial Arbitration Rules. Arbitration shall take place in New York, NY. The arbitrator's decision is final and binding.

Class Action Waiver: You waive the right to participate in a class action lawsuit against SwiftMove USA.

Exception: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SwiftMove USA's total liability for any claim arising from or related to our services shall not exceed the greater of: (a) the total amount paid by you for the specific service giving rise to the claim, or (b) $2,500.

In no event shall SwiftMove USA be liable for: indirect, incidental, consequential, special, or punitive damages; loss of profits; loss of business; or emotional distress, even if advised of the possibility of such damages.

10. Governing Law

These Terms are governed by the laws of the State of New York and applicable federal laws, including the Carmack Amendment (49 U.S.C. ยง 14706) for interstate shipments, without regard to conflict of law principles.

11. Modifications to Terms

SwiftMove USA reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last updated" date. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
